CCLSWA welcomed the opportunity to comment on the proposed Australian Financial Complaints Authority Rules (AFCA Rules) and is pleased to have contributed to a joint submission coordinated by the Consumer Action Law Centre. Other contributors included Care Inc Financial Counselling Service and the Consumer Law Centre of the ACT, Consumer Credit Law Centre SA, Financial Counselling Australia and Financial Rights Legal Centre.

The submission, submitted in July 2018, addresses the proposed AFCA Rules and the issues surrounding the amalgamation of existing complaints schemes and processes. The submission encourages a ‘best practice’ rather than ‘minimum standards’ approach to the AFCA Rules, to ensure there is no watering down of existing consumer protections. The submission is broadly supportive of the AFCA Rules but makes 17 key recommendations in pursuit of the ‘best practice’ approach.
