At CCLSWA we often advise clients in relation to cars they have purchased from car dealerships. These issues range from clients who felt pressured into buying a car they didn’t want to those who happily bought a car which then broke down.

In November 2013, CCLSWA made submissions to the Department of Commerce (WA) on the laws surrounding motor vehicle dealers. The Department of Commerce (WA) subsequently sought further submissions in late 2015.

The submissions look at:
• the Department’s proposal to create a compensation fund;
• the inclusion of statutory cooling-off period’s in contracts to purchase cars;
• the reduction of the pre-estimated liquidated damages motor vehicle dealers can claim from a consumer that breaches or backs out of a car contract; and
• the legal obligation of motor vehicle dealers to repair, replace or refund when a car is faulty.
